The end of dark patterns and complicated cookie walls The (dubious) cookie notifications we've received since the GDPR also need to be changed. Large buttons to quickly accept all cookies combined with complicated menus to reject all kinds of cookies (dark patterns) will become a thing of the past. The options for accepting and rejecting them must be offered in a uniform manner once the Digital Services Act comes into effect.
Other dark patterns are also being addressed. in copy and design is no longer permitted. Instead of a conspicuous button or annoying pop-ups with the option the company wants you to choose to influence your decision, the DSA requires buttons with different options to be presented to users in the same way. Canceling a subscription or service should also be just as easy as canceling it. Consider canceling subscriptions with charities and telephone or energy companies.
The fight against fake news and disinformation Furthermore, there will be restrictions on the spread of fake news and disinformation, for example in crisis situations such as the war in Ukraine and the coronavirus pandemic.
Large online platforms, reaching 45 million people in Europe, will be given additional responsibilities and stricter obligations under the DSA. This is related to the societal impact they can have by spreading disinformation, among other things. For example, the law stipulates that platforms like Facebook and Google are required to take steps against the spread of false reporting or illegal content. For example, tools must be created for users to easily report such content, and platforms must take action as quickly as possible after users report it. They must develop clear, stricter procedures for this. Furthermore, they must commission an annual independent investigation into the threats on their platforms and resolve them. In crisis situations, the European Commission can demand that acute threats on these platforms be restricted for a maximum of three months.
The war in Ukraine demonstrates the challenge of quickly intervening when fake news spreads rapidly. Misleading videos about Ukraine regularly circulate on TikTok , for example, using old footage while claiming to be current. Deepfakes are also becoming increasingly difficult to distinguish from the real thing.
Platforms must also act with precision. According to the DSA, users should be able to object more easily if their post has been wrongly removed.
Stricter rules for online products Finally, the Digital Services Act will include rules to ensure that products sold online are safe and meet the highest EU standards. The goal is to provide consumers with more information about the legitimate sellers of the products they purchase online.
It's clear that the Digital Services Act and its related provisions will be implemented soon. The European Union is taking important steps with this, but it's expected that these rules will eventually become globally applicable.
The DSA offers many benefits for citizens, but for online (social media) platforms and marketplaces, among others, a lot is in store. They will have to take measures to protect users. Because with laws comes enforcement. This will come, at least, in the form of a separate supervisory body for each EU member state to monitor compliance with the DSA. In addition, the European Commission will keep a closer eye on internet giants. Anyone who violates the rules can expect a fine of up to 6 percent of their global annual turnover.
