I’ve been working as a nail tech in a busy salon out on Long Island for about eight years now, and I always knew the chemical fumes weren’t great but figured that’s just the trade-off for doing something I love. Over the last year though my lungs have gotten really bad—constant coughing fits, wheezing, and my doctor recently told me I’ve developed occupational asthma along with some scarring on my lungs that he said is consistent with long-term chemical exposure. I never filed any kind of workers comp claim because I thought it was only for things like falling off a ladder or getting hurt in a sudden accident, not something that creeps up on you slowly. When I finally brought it up to my boss she acted like I was blaming her and said I could’ve worn a mask if I was worried, but the ventilation in there is terrible and half the time the masks they provided were those cheap paper ones that don’t do anything for fumes. I’m really torn because I can’t afford to quit but I also can’t keep working there with the way my breathing is going, and my doctor mentioned that I might have a real case here if I reach out to an occupational illness workers compensation attorney. Has anyone else gone through something similar with a slow-burn kind of workplace illness rather than a sudden injury? I feel like I’m in this weird gray area and I don’t know how to prove it’s from the job after all these years.
